MEMORANDUM
of UNDERSTANDING
Subject: Division of Boating and Ocean Recreation Surfing Contest
Scheduling Policy for Kewalo Basin Park Ocean Waters
The Division of Boating and
Ocean Recreation, Oahu District, has established the following procedures
used in letting Ocean Use Permits for surfing contests/events in the ocean
waters off Kewalo Basin Park.
This policy applies only to
the four surf breaks commonly referred to as:

-
Rennicks
-
Straight Outs
-
Marineland

There shall be a maximum of eight (8) surf contests or promotional events
in a calendar year permitted in the ocean waters designated above with a
maximum of 5 to be held at the Point. The remaining 3 may be held on any
of the remaining breaks.

Contests and events will not be scheduled during legal federal and/or
state holidays.

All contests and
events shall not exceed two consecutive days in length, with the exception
of the NSSA Hawaii Regional Event.

There shall be no holding periods or alternate dates for surfing events.

Events shall not
be scheduled back-to-back meaning no consecutive weekends. (maximum of 2
per month with an 8 per year cap.)

Events may only be
run between the hours of 8am and 4pm.

Kewalo Basin Park ocean
waters shall not be used as an alternate site.

All eight (8) permits will be issued and dates decided at the annual
letting of permits meeting to be held at the beginning of the surfing
season. Each year a meeting date and location will be set by mutual
agreement between the surfing contest organizers and the department. No
additional surfing contest permits will be issued for the rest of that
year. The finalized list of permitted surfing contests/events shall be
posted on the department’s web site.
These guidelines only apply to
the stated ocean recreation areas in paragraph 2 above and in no way
restricts contest or event activities at adjacent surfing areas.
The division has entered into
a good faith, non-binding agreement with all parties in this matter. These
eight guidelines are not to be construed as rules and the division is not
bound by them as such. The division shall, however make every effort to
abide them and encourage all parties to do the same.
